  • What is “at will” employment?
It is a basic principle in California and other states that either employer or employee may terminate the employment relationship at any time, with or without cause.
  • Is this true even if there is a contract between the parties?
Yes. No one can be forced to employ or be employed. However, either party can be charged with damages depending on the terms and conditions agreed upon in the contract, and/or other factors, including the length of employment. 
  • What if I do not have a written contract?
Verbal agreements may be enforced as long as there is some evidence of said agreement, i.e. letters, email, receipt of wages, declarations from witnesses etc.
  • Can I ask for my old job back if am wrongfully terminated? 
Yes. That is one option to pursue to correct the wrong, along with other options, such as recovering damages.
  • What damages can I ask for?
You can ask for unpaid wages and benefits under your contract. There is however a duty on your part to mitigate your damages by looking for work elsewhere. Other types of damages may be available, depending on the severity of the violation.
  • Can I ask for unpaid overtime and holiday pay?
Yes, your employer must pay for benefits such as overtime, night shift differentials, holiday pay etc. that are mandated by law.
  • Do I have to file a grievance first before I can go to court?
Many companies have employment contracts or/manuals which will require you to exhaust your remedies internally. If your employer has a shop agreement/collective bargaining agreement with a labor union, your complaint may also be covered by such agreements. 
  • What if I was fired because of my Race? Age? Gender? Disability?
You may file a complaint for discrimination with the EEOC or the DFEH for any Title VII violation or violation of the Fair Employment and Housing Act.
